In the EU Mx8xRf3 oilseed rape was notified as an existing product in October 2004. The authorisation also includes the individual lines Ms8 and Rf3. In 2007 an application for renewal of an "existing product" was submitted. On 22 September 2009 EFSA published a favourable opinion on the application. EFSA's opinion can be found here.
Austrian Ban on MS8xRF3 oilseed rape:
On 15 July 2008, Austria invoked the safeguard clause to prohibit the marketing of genetically modified oilseed rape MS8, RF3 and MS8xRF3 on its territory. Austria provided detailed reasons listed in a supporting document. On request from the European Commission EFSA had to provide a scientific opinion on the statement and documents submitted by Austria. In June 2009 EFSA published its opinion concluding that no specific scientific evidence, in terms of risk to human and animal health and the environment, were provided by Austria that would justify the invocation of a safeguard clause.
